Exswaping.com Service

Effective date: May 1, 2024

This User Agreement (hereinafter referred to as the “Agreement”) regulates the terms of use of the online service Exswaping.com (hereinafter referred to as the “Service” or “Exswaping”).

By accessing the website, creating an exchange request, or otherwise using the Service, the user confirms that they have read, understood, and fully accepted the terms of this Agreement.

If the user does not agree with these terms, they must immediately stop using the Service.

1. General Provisions

1.1 Exswaping.com is an online platform providing cryptocurrency and electronic asset exchange services.

1.2 Users of the Service may be individuals or organizations with full legal capacity according to the laws of their jurisdiction.

1.3 The Service may only be used for lawful purposes. Users are responsible for complying with the laws of their country.

1.4 This Agreement is legally equivalent to a written contract between the parties.

1.5 Exswaping reserves the right to modify this Agreement at any time. The current version is always published on the website.

2. Subject of the Agreement

2.1 The Service provides cryptocurrency exchange operations between digital assets, electronic money, and fiat payment methods available on the platform.

2.2 Exswaping is not a bank, payment institution, or financial organization.

2.3 The Service acts solely as an intermediary facilitating cryptocurrency exchange operations.

2.4 Any exchange request created by the user becomes final after funds are received by the Service.

3. Exchange Operations

3.1 The exchange rate applied is the rate active at the moment funds are received unless otherwise specified.

3.2 Processing time depends on blockchain network load and payment systems and may take from several minutes up to 24 hours.

3.3 The user must provide accurate payment details including wallet address, network, and payment method.

3.4 If incorrect information is provided (wrong wallet address, network, or card details), the Service is not responsible for the loss of funds.

3.5 Exchange requests must be paid within the time specified during order creation.

3.6 Some exchange operations may require manual processing.

3.7 If the transferred amount differs significantly from the order amount, the Service may recalculate the order and apply a commission up to 5%.

4. Rights and Obligations

4.1 Exswaping has the right to:

suspend transactions suspected of violating AML policies
request transaction verification (TXID)
request verification of bank card ownership
request additional information regarding the source of funds
refuse service if the Agreement is violated

4.2 The user agrees to:

be at least 18 years old
use the Service only for legal purposes
be the lawful owner of transferred funds
provide accurate information

5. AML Compliance

5.1 Exswaping applies Anti-Money Laundering (AML) procedures to monitor transactions.

5.2 Cryptocurrency transactions may be analyzed using:

blockchain explorers
internal monitoring tools
third-party AML analytics services when required

5.3 A Risk Score model may be applied to evaluate transaction risk.

Risk levels include:

Low risk — up to 40%

Medium risk — 40%–60%

High risk — above 60%

5.4 Transactions with high risk may be temporarily suspended for additional verification.

5.5 Verification procedures may include:

transaction hash confirmation (TXID)
bank card ownership verification
source of funds confirmation

5.6 AML review may take up to 24 hours, and in complex cases up to 3 business days.

6. Refund Policy

6.1 If an exchange cannot be completed, funds may be returned to the sender.

6.2 For legitimate users whose funds pass AML checks, the refund fee is limited to blockchain network fees only.

6.3 In cases involving AML risk, a commission up to 5% (but not exceeding 100 USD equivalent) may apply.

7. Cryptocurrency Addresses

7.1 For some exchange directions, the Service may generate unique deposit addresses for each order.

7.2 In certain cases, service liquidity pool addresses may be used.

7.3 All transactions are recorded on the blockchain and can be verified publicly.

8. Liability

8.1 Exswaping is not responsible for:

delays in blockchain networks
actions of banks or payment providers
errors made by users

8.2 The Service does not provide financial, legal, or investment advice.

9. Privacy

User data is processed according to the Exswaping Privacy Policy.

10. Prohibited Use

The Service must not be used for:

fraud
money laundering
terrorist financing
sanctions evasion
illegal activities
